The British Supreme Court has addressed, with the help of eleven judges, the thorny issue of relations between Parliament, the Crown, the Government and the Su- preme Court itself, restating once again the supremacy of the role of Parliament both as a legislative body and for the control over the Government’s work. With a historical reconstruction, the Court has out- lined the limits to the exercise of the prerogative by clar- ifying how parliamentary activity cannot be compressed and limited by a reckless use of the parliamentary right, that would produce a “vulnus” into this delicate balance – inspired by the principles of loyalty and correct collabo- ration – between the powers of the State.
La Suprema Corte inglese ha affrontato, con un pannel di ben undici giudici, lo spinoso tema dei rapporti tra Parlamento, Corona, Governo e Corte Suprema stessa, ribadendo ancora una volta la supremazia del ruolo del Parlamento sia quale organo legislativo che di controllo sull’operato del Governo. Attraverso anche una ricostruzione storica, la Corte ha delineato i limiti all’esercizio della prerogativa chiarendo come l’attività parlamentare non possa essere compressa e limitata da un uso sconsiderato del diritto parlamentare che produrrebbe un vulnus nel delicato equilibrio - ispirato ai principi di lealtà e di corretta collaborazione - tra i poteri dello Stato
