This paper analyzes the National Federal Court Decision No. 0040/TFNSD- 2023-2024 of August 1, 2023. The National Federal Court – Disciplinary Section – in this decision, addresses the relationships between state and sports systems, delimiting the competence of sports justice bodies within the limit of “sports competition”. The novel point of the decision is the verification of the stability of these relationships in the aftermath of the Sport reform and of the entry into force of Legislative Decree no. 39/202. The Court confirms the scope of operation of sports justice in sports activities also in light of the new legislation, qualifying the art. 16 of Legislative Decree no. 39/2021, entitled “Risk factors and combating gender violence in sport”, of Title III “Fighting gender violence”, a programmatic rule which presupposes the timely implementation of federal bodies. The tenor of the provision confirms the current absence of immediately preceptive rules which, following an assessment – left to the federal legislator – of the reasonable relevance of the conduct for domestic law, impose sanctions in relation to conduct such as that in dispute. Lastly, in the aftermath of the decision in question, the FIGC, on 31 August 2023, adopted the “Guidelines”, for the preparation, by sports club, of the organizational and control models of sporting activity and of the codes of conduct for the protection of minors and for the prevention of harassment, gender violence and any other condition of discrimination provided for by Legislative Decree 11 April 2006 n. 198 or for reasons of ethnicity, religion, personal beliefs, disability, age or sexual orientation.
Il presente contributo analizza la decisione emessa in data 1° agosto 2023 dal Tribunale Federale Nazionale – Sezione Disciplinare, n. 0040/TFNSD-2023-2024. Il Collegio affronta i delicati rapporti tra ordinamento statale e sportivo, delimitando l’area di competenza degli organi di giustizia sportiva entro il limite “dell’attività della riforma dello Sport e, in particolare, dell’entrata in vigore del d.lgs. n. 39/2021. Il Tribunale conferma il perimetro di operatività della giustizia sportiva, già tracciato dalla giurisprudenza sportiva, nei limiti dell’attività sportiva anche alla luce della novella legislativa, qualificando l’art. 16 del d.lgs. n. 39/2021, rubricato “Fattori di rischio e contrasto della violenza di genere nello sport”, del Titolo III “Contrasto alla violenza di genere”, norma programmatica che presuppone l’attuazione puntuale degli organi federali. Il tenore della disposizione conferma l’attuale assenza di norme immediatamente precettive che, all’esito di una valutazione – rimessa al legislatore federale – di ragionevole rilevanza dei contegni per l’ordinamento domestico, comminino sanzioni in relazione a condotte come quelle in contestazione. Da ultimo, all’indomani della decisione in esame, la FIGC, in data 31 agosto 2023, ha adottato le “Linee Guida”, per la predisposizione, da parte delle società sportive, dei modelli organizzativi e di controllo dell’attività sportiva e dei codici di condotta a tutela dei minori e per la prevenzione delle molestie, della violenza di genere e di ogni altra condizione di discriminazione prevista dal Decreto Legislativo 11 aprile 2006 n. 198 o per ragioni di etnia, religione, convinzioni personali, disabilità, età o orientamento sessuale.
