The execution of public contracts, in light of recent reforms, continues to present significant critical issues in the event of a crisis, despite the long gestation of the new rules which occurred in the context of application problems that have been known for years in both doctrine and jurisprudence. On the other hand, it is a problem that often occurs in the dialectic between public law and commercial law due to the overlap of interests that are not always convergent and interdisciplinary visions that are often distorted by the different approach. For this purpose, it is enough to think of publicly held companies where the nature of the subject and the nature of the economic activity carried out constitute the theoretical basis for the scrutiny of a multitude of interpretative questions and which for years have produced, especially on the public sector side, significant antinomies.
L'esecuzione degli appalti pubblici, alla luce delle recenti riforme, continua a presentare significative criticità in caso di crisi, nonostante la lunga gestazione delle nuove regole intervenuta nell'ambito di problemi applicativi noti da anni sia in dottrina che in giurisprudenza. D’altronde è un problema che spesso si presenta nella dialettica tra diritto pubblico e diritto commerciale a causa della sovrapposizione di interessi non sempre convergenti e visioni interdisciplinari che spesso vengono distorte dal diverso approccio. Basti pensare alle società a partecipazione pubblica dove la natura dell'oggetto e la natura dell'attività economica svolta costituisce la base teorica per l'esame di una moltitudine di questioni interpretative e che da anni producono, soprattutto sul versante del settore pubblico, antinomie significative.
