Gli effetti del fallimento della società sportiva sui rapporti in corso di esecuzione

Il fallimento della società sportiva non produce la perdita del diritto al riconoscimento delle condizioni tecnico-sportive, a prescindere dall’esercizio provvisorio o meno dell’impresa fallita, salvo il mancato interesse del mercato al relativo acquisto. Il titolo sportivo in fin dei conti configura la convenzione base con il sistema per esplicare l’attività economica dell’impresa stessa. Di conseguenza, i contratti di lavoro si risolveranno secondo le regole generali e non certo d’autorità sulla base di norme organizzative interne che finirebbero col depauperare i valori aziendali.
