The term digital lobbying refers to the innovative way in which people and organisations (private and public) manage public affairs activities through the use of digital platforms, in the policy making phase, through crowdsourcing and crowdlaw actions. In our legal system, there is no regulation of lobbying activities, even though they are an essential part of the governmental and parliamentary decision-making process. The phenomenon, therefore, exists but remains on the margins of the institutions as a movement of opinion or pressure which is known but not regulated. And yet, the discipline of lobbying activity has been the subject, for years, of study and legislative initiatives which have never come to a conclusion. For a correct legal framing of the phenomenon, it is necessary to get rid of the prejudice of considering lobbies a hidden power that hinders and distorts the decision-making process. The contribution of organisations that want to influence political decisions should not necessarily be understood in negative terms, however, their contribution must be transparent and knowable. Technology and digital technology provide the lobbyist with an additional tool for participation in the decision-making process, expanding its legitimacy by ensuring the transparency of positions and interests involved. The close correlation between e-democracy, e- government and digital lobbying suggests the implementation of legislation of digital procedures for public decision-making.
Con il termine "digital lobbying" ci si riferisce al modo innovativo con cui soggetti e organizzazioni (private e pubbliche) gestiscono le attività di "pubblic affairs" attraverso l'uso di piattaforme digitali, nella fase della "policy making", attraverso azioni di "crowdsourcing" e "crowdlaw". Nel nostro ordinamento non vi è una disciplina dell'attività di "lobbying", pur essendo parte integrante del processo decisionale governativo e parlamentare. Il fenomeno, dunque, esiste ma rimane ai margini delle istituzioni come movimento di opinione o di pressione conosciuto ma non normato. Eppure, la disciplina dell'attività di "lobbying" è oggetto, da anni, di studio e di iniziative legislative mai giunte a compimento. Per un corretto inquadramento giuridico del fenomeno è necessario di liberarsi dal pregiudizio di considerare le lobby un potere occulto che ostacola e distorce il processo decisionale. L'apporto di organizzazioni che vogliono influire sulle decisioni politiche non va inteso necessariamente in termini negativi, tuttavia, il loro contributo deve essere trasparente e conoscibile. La tecnologia ed il digitale permettono al lobbista di avere un ulteriore strumento di partecipazione al processo decisionale, ampliandone la legittimazione garantendo la trasparenza di posizioni ed interessi coinvolti. La stretta correlazione tra "e-democracy", "e-government" e "digital lobbying" suggerisce l'implementazione della legislazione delle procedure digitali per la formazione delle decisioni pubbliche.
