This essay aims to investigate the concept of tacit approval, in light of the need for legal certainty that must guide interpreters in the presence of an ambiguous regulatory framework, characterised by variations of the jurisprudence. The results of the analysis, conducted in the light of positive law and general theory, show that the stability in the application of the tacit approval requires the classification of it within the “rule-facteffect” framework, which would make it possible to preserve intact both the reasons of public interest (protected by the constrained requirements of the legal figure, which are essential for the production of the effects) and individual freedoms, which are destined to expand with the expiry of the deadline, that extinguishes the (only) discretionary part of the legal figure.
Esaurimento del potere, tecniche di produzione degli effetti e certezza dei rapporti giuridici: il caso del silenzio-assenso “norma-fatto-effetto”, che consentirebbe di preservare integre le ragioni sia dell’interesse pubblico (tutelate dai requisiti vincolati della fattispecie, imprescindibili per la produzione degli effetti), sia delle libertà individuali, destinate a riespandersi con il decorso di un termine, che estingue la (sola) parte discrezionale della fattispecie.
