The article critically examines the evolution of trade union representation in Italy in light of constitutional and supreme court case law, with particular reference to Constitutional Court judgment no. 156/2025. It analyses the implications for collective bargaining, wage protection under Article 36 of the Italian Constitution, and the interaction with EU Directive 2022/2041. The contribution highlights the systemic tensions between national models of representation, company-level bargaining, and European Union law.
