On the one hand, it provides a careful assessment of the Italian market for film screenings to the public to date and, in carrying out this assessment, it presents an examination framework of the economic sector of film distribution, the interests of the companies that manage this phase of the supply chain and the impacts that demand undergoes downstream. On the other hand, it observes the complex interaction between the various economic networks that evolve upstream and downstream in the process of exploitation of films in cinemas, ascertaining a complexity of interests between the different actors of the economic chain between vertical and horizontal business networks. In this context, the need to safeguard the free summer arenas by guaranteeing them an adequate supply of cinematographic works to be screened and such as to support a convenient film programming seems to be paradigmatic. In this way, also on the general level of competition in the sector, safeguarding alternative opportunities and innovative ways of exploiting the work, such as free screenings of films in summer open-air arenas, allows the Italian film market to defend itself from the economic strategies dictated by the main companies that dominate the sector.
Il provvedimento dell’Agcm oggetto del commento è significativamente interessante per l’ampia analisi della concorrenza che conduce sull’industria cinematografica italiana. Da un lato, fornisce una valutazione attenta del mercato italiano delle proiezioni cinematografiche al pubblico fino ad oggi e, nell’effettuare tale valutazione, espone un quadro d’insieme del settore economico della distribuzione dei film, degli interessi delle imprese che gestiscono questa fase della filiera e degli impatti che la domanda subisce downstream. D’altro, osserva l’interazione upstream e downstream nel processo di sfruttamento dei film nelle sale cinematografiche, accertando una complessità di interessi tra i diversi attori della filiera economica. In questo quadro appare essere paradigmatica la necessità di salvaguardare le arene gratuite estive garantendo loro un adeguato approvvigionamento di opere cinematografiche da proiettare, tale da sostenere una programmazione filmica conveniente. In questo modo, anche sul piano generale della concorrenza nel settore, salvaguardare opportunità alternative e modalità innovative di sfruttamento dell’opera, come le proiezioni gratuite di film nelle arene all’aperto estive, consente al mercato cinematografico italiano di difendersi dalle strategie economiche dettate dalle principali imprese egemoni nel settore.
