This paper aims to analyse the contribution of disability studies in education to the rethinking of legal education. The issue is analysed within the broader context of the debate on the crisis in legal studies that began in the 1970s. The path of cooperative learning is challenged by the need for a synergistic relationship between teaching and technology, which finds its reference point in the construction of teaching as a science of design. The centrality of the active role of the student and their abilities is developed critically, starting from Nussbaum’s capability approach and the reconstruction of the relationship between democracy and education articulated in the thinking of John Dewey.

Abstract

This paper aims to analyse the contribution of disability studies in education to the rethinking of legal education. The issue is analysed within the broader context of the debate on the crisis in legal studies that began in the 1970s. The path of cooperative learning is challenged by the need for a synergistic relationship between teaching and technology, which finds its reference point in the construction of teaching as a science of design. The centrality of the active role of the student and their abilities is developed critically, starting from Nussbaum’s capability approach and the reconstruction of the relationship between democracy and education articulated in the thinking of John Dewey.
