The author outlines the aim of offering a contribution to the studies on the unresolved “jurisdiction issue”. We start from recent judgements of the Cassazione and the Consiglio di Stato, which reflect diametrically opposed orientation of the two higher jurisdictions on the jurisdictional competence in the dispute on an administrative act – allegedly – bound. After representing the different orientation on the “classification” of the action adopted pursuant to art. 4 d.l. n. 44 April 1° 2021, it proposes an investigation, also historical, on the centrality that has, always, covered the administrative discretion on the subject and, concluding, we go in search of a plausible logical solution is sought, in the still problematic current allotment criterion
