Italy’s adoption of the law authorising the establishment of the EEZ seems to reverse the Country’s traditional policy on the subject. The delimitation of the marine zones for which the Mediterranean Sea coastal States are competent, in fact, has always been a complex issue, not only from a strictly legal point of view, but also on the political, economic and environmental level. An holistic approach to the issue, which takes into account, in addition to the legal discipline of the interests involved, also the historical context, the geographical and political aspects concerning the subject, allows to assess its cross-cutting value and to appreciate the need for a larger cooperation between the involved States and the role of the European Union.
L’adozione, da parte dell’Italia, della legge che autorizza l’istituzione della ZEE sembra voler invertire la tradizionale politica del Paese sul tema. La delimitazione delle zone marine di competenza dei Paesi che affacciano sul Mar Mediterraneo, infatti, da sempre costituisce una questione complessa, non solo da un punto di vista strettamente giuridico, ma anche sul piano politico, economico e ambientale. Un approccio olistico alla questione, che tenga, cioè, conto, oltre alla disciplina giuridica degli interessi coinvolti, anche del contesto storico, geografico e politico permette di valutarne la portata trasversale e di riflettere sull’esigenza di una maggiore cooperazione tra gli Stati coinvolti e sul ruolo dell’Unione europea.
