Human dignity represents a right that belongs to individuals as such, so, for this reason, the article 3 of the ECHR states its absolute incompressibility, also in conditions of detention. The recent judgement of the European Court of Human Rights in the case Viola v. Italy relating to “preclusive” life sentence, not only reaffirms the primacy of human dignity, but also contribute to the affirmation of the “right to hope” that consists in the right of the convict to get back, one day, his freedom.
